Terms of Service

Overview
By accessing and using artymclabin.com, you agree to these terms. If you do not agree, please do not use this site.
Production Services (/produce)
Indicative only. The pipeline configurator, pricing tiles, and total-posts calculator on /produce are provided for estimation and discussion purposes only. Numbers shown there are not a binding offer. Every engagement is negotiated and confirmed in a separate written agreement (proposal, email confirmation, or signed statement of work). The negotiated terms of that written agreement take precedence over anything displayed on the site.
The points below are general defaults that we typically apply, so prospective clients know what to expect before we talk. Any item can be adjusted, removed, or replaced by the negotiated agreement.
- Bundle pricing (default): Production is typically sold per long episode. The base bundle generally covers one long video (approximately one hour), shorts, copywriting, distribution, and host + guest cross-promo posts. Mediums (mid-form highlight cuts) are typically offered as an optional add-on. Pricing tiers displayed on /produce assume English-language production; other languages may price differently. Final price is set in the written engagement.
- Templated thumbnails (default): Templated thumbnails are typically included. Creating a brand-new thumbnail template (for example, for a new podcast brand, newsletter, or custom platform) is typically quoted separately during onboarding.
- AI tooling and tokens (default): Cross-promo copywriting typically runs through our internal ContentFactory app using premium Anthropic models (Claude Sonnet and Claude Opus). For default engagements, API subscription and token usage are included with no separate billing for token consumption. Heavy-use or custom-prompting arrangements may be billed differently.
- Client deliverables (default): Client supplies raw footage (or attends an agreed studio recording session), guest contact details for cross-promo handoff, and brand assets if applicable. Client warrants they hold all rights necessary to record, edit, and publish the supplied content.
- Distribution authorization: If the client chooses for the studio to handle posting, the client authorizes us to schedule and publish content on the platforms they specify, using accounts they administer. The client remains owner of all platform accounts. Exact scope is set in the engagement.
- Intellectual property (default): The client typically owns the final edited video, shorts, mediums, thumbnails, and generated copy. We retain ownership of our production process, templates, prompts, and the ContentFactory software itself. Different IP arrangements can be negotiated.
- No outcome warranty: Production services are provided on an as-is basis. We make no representation or warranty regarding view counts, follower growth, conversions, or any specific audience or revenue outcome. Results depend on the underlying content, audience, and factors outside our control.
- Cancellation (default): Unstarted bundles can typically be cancelled before edit work begins. Bundles in progress are typically billable to the stage already completed. Specific cancellation and refund terms are set in the written engagement.
Consulting Services
- Consulting sessions are billed at the rate displayed on the consultation page.
- Money-back guarantee: The applicable refund window and conditions are those displayed on the offer page on which you purchased the engagement (e.g. the consultation page). If no specific guarantee is stated on that page at the time of purchase, no refund is offered.
- No outcome warranty: Consulting advice is provided on an as-is basis. I make no representation or warranty — express or implied — regarding business outcomes, revenue, profits, growth, or any other specific result. Results depend on your circumstances, execution, and factors outside my control.

Limitation of Liability
This site and its services are provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
Cap on liability: To the maximum extent permitted by law, my total aggregate liability arising out of or related to any engagement, this site, or any consulting advice provided shall not exceed the fees actually paid by you for the specific engagement giving rise to the claim.
Excluded damages: In no event shall I be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, or goodwill — even if advised of the possibility of such damages.
